Normally, most trusts are administered entirely privately and outside of the probate court. However, probate court approval is required for certain trust modifications, and some trusts expressly require court oversight of ambiguities, accountings or distributions.

The lack of judicial oversight in trust administration also can result in trustee malfeasance. The probate courts have jurisdiction over disputes regarding the actions of a trustee.
